    No it's not legal, but most big sites can't be arsed with the hassle of chasing it up.

    Straight copyright infringement. youporn, porntube, and a bunch of others just got smacked with copyright infringement suits from the big guns like Vivid. The porn industry is big on protecting their IP for good reason.

    Yea, it's illegal but I'm sure the website has a disclaimer protecting it from blame about what users upload.

    A disclaimer gives the no legal protection in this case. They would need much more that.

    9th circuit (US) ruled that websites are liable for user uplaoded content. also big media guns and their proxies will make sure medium size fish with big asp dont catch up with them. so they will come heavily after stolen copyrted content....
