Is this torrent site illegal?

I'm planning on starting a private adult torrent website. My question is, members will be able to upload and share their torrents. I will not be monitoring these files, I just want to make this website for profit not as a hobby, so I wont know if the files are copyrighted or not. I'm talking about mostly videos being shared here, now how can I go about this legally?? It's going to be a forum, and I know alot of file sharing forums have been shut down and its owners arrested, so I want to avoid this situation by keeping it legal. Now im my opinion, I see this as being the same as those other video streaming websites but this one lets you download the files.

biggest mis conception in the world , bit torrent is totally legal, i.e is the protocol , what it used for is upto the users , as for starting a tracker you entering a field where many brave ones have fallen and some stubborn ones still stand proud, if you want a tracker the 1st you don't do is ask for advice on a open forum:p bit torrent file sharing is for people who really belove in it, and yes you will be hounded , and most likely shut down too, the variables are too much , where you live , where the tracker is hosted from , where the d.c is all comes into play , do you make money out of it ? if you don't then in u.k the owner and admin of onik just walked free after nearly 3 yrs of prosecution , while TPB is still number 1 targeted site but is still up and running despite having number of cases i have given up counting now, where as minova folded up and just hosts legit files now.

this is a very funny and testing time for bit torrent lovers and if you know nothing about it i should suggest you keep out of it, it is not for weak hearted :p

I dont want to host illegal movies or music, so I guess my question is, are adult videos illegal to share? I mean, I know that some of them are copyrighted, but aren't the majority not copyrighted?

porn industry is more strict when it comes to copy rights and employ ppl just to track down such vids, how will you know what the uploader just indexed , will it carry a nfo from production house , saying 'hell ya which just gave this tracker our work to be spread on net ' will you buy them ? or yr uploaders will buy them  there is no way of knowing that . many inde groups and producers are seeing the sense of going file sharing way when releasing new stuff like the producers of 'NINE' and countless music albums which are released by owners themselves , now that is legit !

porn is a very different matter and there is NOT is single production house in porn which allows that.

    your above statement
makes you perfectly fine game for hunting down. if it had been the other way round then you would found going easy.

Here is what's going to be 100% of your problem.

Starting something online where people are allowed to upload stuff, but you won't be monitoring it ? That is a recipe for disaster.

There is no such thing as a successful online business that you don't monitor.
There is no such thing as a successful business, that you don't monitor.

In no time at all, not only will you have members uploading copy written material and breaking all kinds of laws, but you are opening yourself up to illegal porn as well, like Child Pornography, since you won't be paying attention. And yes, you will be liable.

I think you should find another way to make money online...one that you have the time to manage.

If you don't have the time, then just give up now. No sense in wasting money on something that is going to fail because you can't actually take the time to make it a success.

Agreed with hmansfield. Throwing a blind eye doesn't cure your problems. And yes, the moment something illegal goes up that is property of big bucks companies, you're getting ready to be boarded.
