Read the contributory infringement link I provided. Basically you can be held liable for linking to illegally provided copyrighted material regardless if you host the file or not, since you are facilitating the the copyright infringement/piracy.

 

Currently its not something that is really enforced is it. Sites doing the exact same thing have been going successfully for a long time and have been safe from any legal problems.

 

Actually I think the chances of it being enforced is getting much higher. The TV networks are particularly active in this arena.

As with all things in life you have a choice whether to create a warez site and accepting the risks that come with owning one. The point is that it is illegal, and that you could possibly face legal issues down the line. It's up to you to decide if it is worth it and if you are prepared to face legal battles if they occur.

 

Its dependent on the case, like it says in your article "a number of cases". Something outright illegal is illegal full stop. Not all sites linking to the material would be deemed illegal in court which is why companies haven't been able to shut down sites like albumbase and all the others.

 

That is true, but this is a relatively new area for the law and what is and isn't acceptable is constantly being explored. The legal precedent has been set for similar cases, so the chances of a site being found guilty is much higher.

Most of these sites hide behind the "safe harbor" provision of the DMCA. However if these cases go to court I think it can quite easily be proven that the site is party of willful infringement if their members uploads/links to something like the latest 24 episode. Try proving that you didn't know something like that was copyrighted...

You also need to actively remove any infringing content if you are notified and have clear and easy method of being notified of infringement... which most of these sites don't have. So DMCA won't offer much protection.

 

If it were something as YouTube where people can post their own made movies/videos, then that would be legal. However, this is a copyright infrigment, you are at risk.

 

Nice site, bit it is doomed. I like the way, you can jump straight onto a movie.
It's neat and fast. Copyrighters would much rather it was a bad jumpy copy.
