I'm creating a search and win website.

Here is what the person said that I hired to make the search engine script.

    Is that legal to do?

I'd look at the terms of use for ask.com, there's a good chance they might not be to happy about you using a script to grab their search results. Then again they might not care. It's best to do some research before implementing such a script.

The site swagbucks.com and others do it so I'm sure it's fine, but you'd probably want to ask.

Others do it so it must be fine is a horrible answer to a question like this. Others speed and steal all the time so that must be okay too, right? As far as the actual question though, most of the major search engines provide a free search tool that can be integrated into any site. Ask.com has one as well (the code generator for it can be found here). The ToS for using it can be found here. If he got the script from them and the use conforms to the ToS then it is fine. If not, then there could be issues.

It sounds like a "meta-search engine" like dogpile.com - it takes results and collates from other search engines.

I'm not sure how else you intend to get search results. Creating your own search engine and indexing all the pages on the web is a huge and expensive undertaking.
