is this legal?

    Hi

    Recent i bought of the domain name .net, the guy start a community website within 2 month he got about 2000 members but he din't buy .net so i check the domain avabilble so i grap it...now he threat to sue me :)

    You have to see if he trademarked the name or not. If he didn't trademark it, there's nothing he can do.

    If it is a registered trademark or brand name then yes he has a case, if not then I do not think there is much he can do about it.

    Was the threat from a licensed lawyer, or from himself?

    If it was just an angry email from him, and the URL is not a registered trademark/brand then I do not think you have much to be worried about.

    Rule of Thumb : If a domain is going to cause you legal hassle, always consider if the domain name is truly worth the aggro, maybe nothing you need to worry about at this stage, but if it progresses it is somehting you should think about.

    I doubt he can sue you for that. He could buy it from you, though.

    thats what i would do have him give you like $25 dollars for it which isnt that much but better than nothing.

    Thanks all for the advices... the site pretty new and no trade mark or anything...He just send me an email said he want the domain .net :)

    Here is another thing, we both(other guy) run a community website and our target members are the same

    If the name is not a Registered Trademark or a Brand Name, then most probably you are safe using the name.

    it would be helpful if you gave us the domain.
    for example if he had
    google.com
    and you regged google.net
    then you might have some issues
    however if he had
    keyword.com
    and you regged
    keyword.net
    then you have 0 problem
    brandable names can have trademark issues, keyword names dont

    Ask for $150, I am sure you can get him to pay that much. Or better yet, outrank him on all important keywords and then sell the domain to him :).
