I was looking at buying a domain and the one i wanted was already taken and being used. So i tried a few alternatives are aviable, but wanted to know if there was a tm or copyright infringment! The domain being used: ***chat.com domain i waant: ***chatter.com The *** are the same letters but the type of sites would be completely different?
I'll assume *** is xyz... So if xyzchat.com is a online chatting website and your getting xyzchatter.com which is for something completely different (like maybe a chat software?) then your safe. Your also safe if you make the same sort of site because chat and chatter are 2 different words. But i wouldn't just to be on the safe side
It's impossible to give an informed answer without knowing the exact domain name - but it's entirely possible that it would trademark infringement - especially if they were both "chat" related. The best way to proceed would be to consult with an ip attorney - but you could also spend a few hours reading about trademark law to get a better idea of what can constitute infringement. If the other party "thinks" it is infringement, then they can file suit and you will be faced with huge legal fees if you decide to fight the case.
it always depends on how much attention you draw or how many similar websites are out there.. I know of someone who has a website with "youtube" in the domain name for over a year now, making $40 of adsense daily and no one from youtube has ever complained, but then again there must be thousands of similar websites
