    but dont put same menu above or below of that link units IMO

    The above link seem to be like site menu, which can get problem for u, don't use orange background, use one header Ad unit 728x90 (Text only) and then below that u can use Link unit but it must not look like menu.

    for Example :-

    Give headings :-

    Advertisment:-
    Header 728 AD goes here (white back)
    728 Link Unit

    this will not only increase your CTR rate but by using Advertisment Heading and using white backgorund it will safe you from getting ban from Google.
