Is this a violation of copyright laws?

    If I download videos from sales page of some clickbank product and upload it to youtube is it a violation of copyright law? What is your opinion?

    If you don't have permission and you don't own the video, then YES it is.

    I'm not a lawyer lol, but the first thing I'd do is ask the website owner for explicit permission.
    Get something in writing if you can and for extra protection seek qualified legal person :)

    Well did you make the video? No

    Do you have the permission who did to put it on youtube? No

    Then yes, it is a violation of Copyright.

    First check It could be not a copyrighted material. like some advertisements. the owner sometimes makes it not copyrighted to get wide spreading.

    Based on what I have learnt, whoever create something he or she is owns the copyright of "the thing" created. No need black and white document. The moment something has been created, the copyright is owned by the creator.

    The copyright can be transferred though.

    I am just curious why do you want to upload the sale video to youtube? Does it help to improve your sales? I would think most people upload videos to youtube is to drive traffic. i.e. people watch a video on youtube and they are interested to find out more, they click the link embeded and direct them to a sale page or any other website.

    In this case, assuming that you are allowed to upload the sales video, where do you want to direct your viewers to?

    I am just curious. :) perhaps it's your own method to drive traffic or for any other objective.

    Ya. I guess it is fine to ask the product owner to give you permission to do that.

    no because you're his affiliate and you have the rights to use the content within the vendor's site including banners, articles and videos, as long as the purpose is to promote his product

    Agreed.. As long as you are using the video to promote his product then it's fine. But if you are in doubt, you can ask the owner for permission.

    Not always true.. You have the right to use what the vendor allows you to use.. If the creator doesn't want you using their content, then you can't..

    I think bizjam55 is absolutely right. If you don't have any permission then you can't do that.
    Definitely it's a violation of copyright law.

    well, basically, yes. If you don't have permission and you don't own the video, then it would be against copyright laws. But i assume that the owner of the video would definetely consent to the usage of the video, because if you work as an affiliate for him, then it is in his interest to let you do your business as you do it best.

    You can do if you are damn sure that the owner may not go to court appealing for copyright issues. Better, have a word with him before you proceed. I think things will be favored for your move since you are promoting his products

    Unfortunately what is deemed as common sence might not be the same thought of the vendor who owns the material. If the video is in an "affiliates" area then its very likely that you can use it (Hello? thats wht its in this area) - but if its on his sales page, he might or might not want you to use it.

    Always check with the vendor to avoid any problems. Everyone is different, and some vendors dont mind while others do.
