I have www.YellowUSApages.com registered and now I got a little conserned and have to ask before I continue to develope and promote it ... Will YellowPages hunt me down or not ? I think it should be okay ... I do have yellow and pages in my domain name, but I do NOT have yellowpages ... What do you guys think ?
there is not a issue...its ur domain and u purchased it....its not important that the name should always click the site content... plenty of sites whose domains donot match site content... its not at all an issue
You could search the US Patent and Trademark office to see if "Yellow pages" is a trademark. If not, you should be fine. I've seen many different local pages use the term loosely. Alex
Alex, as I see it, I don't even have "Yellow Pages" in my domain name! I have "Yellow" AND "Pages" ! I wanted to hear your opinion, but as I see it, it should be no problem. If it's an issue, then domain names like YellowBookPages.com, YellowPaintPages.com also would be in trouble and I can't believe that ... So, I'll go on developing my site ... For now my domain is a keeper
there is not prblem dude..its your domain with different name..it no yellowpages..its deffierent you can also use yellopages..hehe mine is googledaily.com there are still other like this googleurdu.com, googldaili.com also some other sites are having same name like 4shared.com, 2shared.com and alot of site With the word "TUBE" as youtube is exactly..you dont need to worry
YellowUSAPages seems to be fine due it not containing the Trademark "Yellow Pages." Side note: A Trademark does not need to be registered with the US Patent office to be considered a trademark, but then others can use it in different fields. The poster above (googledaily) however is using the registered trademark "Google." It should be fine, but if Google does sends a C&D letter, I would definitely shut down the site or you can get sued. :/
Actually my site name is not "Google" or "Google Daily"..my site name is "googledaily"..its a one word..also you can generate google like logo at googlefont.com.. the font in which google logo is created is not google's font..the font is called catull..and anyone can download it form sites..I also downloaded from internet.. Why "megaupload.com" dont sue "megashare.com" using their "Mega" why "youtube" dont sue "porntube" for using "tube" with same logo and words.....and why 4shared.com dont sue 2shared.com??? If you talking about ethics? google is a big ****ing company in this world so far. which has enormously voilated the copyright rules in the world so far..talk about youube.com...howm much they have voilated laws by uploading the content which worth billions of dollers????? Every new song and tv program which are striclty under copyright laws in world and even in America are uploaded at youtube at their released day at tv..whyyy thousands of singer from hollywood dont sue youtube??? Why American and Indians host crack and serial sites even though they are biggest producers of software industry??? Do you still think i deserve a sue?
I didn't mean to offend you. I do not think you deserve to be sued. I am just saying Google can sue you if they send you a C&D letter and you do not release the domain name to them. By using the made-up word "Google" in your domain name, you are infringing on their trademark. Just be careful. I am not sure about the other websites you mentioned. I'm just trying to help the OP.
You are clearly infringing. You are giving shit for legal advice in nearly every thread. It will catch up to you in several ways.
Here's the thing... you can do whatever you want... Pickup a domain, add a website, promote a website and start making money on it... ...and they can do whatever they desire and if they decide [someday] to send a C & D and advise you to transfer the domain to them or they will sue... it is in your best interest to go to court or kiss all your hard work good-bye? Yellowpages is a well known brand... and your domain is clearly meant to ride on the success of a brand they spent years building and millions promoting... and no matter how you rationalize your position you "confuse" the market with a somewhat different brand clearly meant to confuse the market in your favor. I doubt you keep your domain even if you fight... so the only question is "at this early stage... what is it worth to you"?
Your intent is clear... you are better off not ever using or promoting the domain... you'll lose it and you won't get a penny in return.
