Is the seller LIABLE to ship the goods to buyer on ebay???

I purchased some templates on ebay for $7.94 and immediately made the payment through paypal. However even after several PMs and mails from me, the seller doesn't seem to be willing to even contact me...
And he/she has been online on ebay after that(I know this because he posted the same product again for sale)

Is there any legal action I can take to get my money back?? If there is..who should I contact (Paypal/eBay)??

Any help would be appreciated.. Thanks in advance

I would open a ticket with Ebay, and they should be able to assist you in getting your money back ASAP. Per the ebay TOS, completed auctions are legally binding and the seller is obligated to sell the item if the reserve has been met.

@imbo: Thanks, I found the link, but there's one more day left for the shipping, So I think I'll file in the application then..

But how do you guys know if it's a scam or not.. I know there may not perfect answers to that but I'd love to have some pointers like how good must the feedback of the seller should be and stuff like that..

You should try ask a lot of question to the seller before buying.
If he ignore you then, don't buy from him.
And don't forget to get his IM screen name such as MSN.

You can never be too sure on eBay right now. A lot of sellers and buyers being defrauded just like that. You have to file a claim through Paypal or contact eBay phone support and you can find the toll free number on the website itself.
