    If my website is a warez website
    but the main page (index) has no warez. - only the posts has warez linking
    is it legal to put ads in the main page (there is no copyright infringement) ? can i get banned because of this?

    If you are talking about adsense, then you will sooner or later get banned, they
    are not isolated to the home page, and they will look at your entire site, and if
    a human does not, then spiders certainly will, and I suspect that any ad management site would ban you if they catch you doing this; not only that, google
    could go even further by penalizing your site, then you are no where to be found.

    Adsense requires SITES to be compliant with the guidelines, not just PAGES.

    Big G doesn't like copyright infringements of any kind, they will treat your site as a whole, i.e. if one page as warez it's a warez site: period. It may take someone to report you before they act
