Its not really a crime, in fact a bad habit. If smoking would have been crime then drinking would also be. Not really More than 30 million people smoke in Japan according to an wikipedia article.
In CA it’s a crime if u smoke in Bars and Rest, clubs, some places u can't smoke near a enterance. Some area like university are sometimes banned. U won't u go to jail, but ull pay a fine, i think its around few hundred.
What do u mean by smoking is a crime? It depends on what u smoke if u smoke coke then its a crime all over the world i guess and if you smoke (normal cigarette) in public then i think the people around will not feel comfortable and i dont think normal smoking is a crime but i would suggest you not to smoke as Smoking KILLS
Smoking indoors in most public places is now illegal in Canberra. I'm very happy about this, smoking is very dangerous and irresponsible.
In some countries, smoking at public places is crime. But still they can smoke at their home. But it's really very bad habit.

People, the OP asked about countries like Japan or Taiwan. Personally I don't know, but it's possible in certain countries to consider smoking as a crime.
I don't really know about Japan and Taiwan, but in my country Ghana, it's a crime to smoke in public places and advertise or promote any form of smoking or tobacco product.
Smoking is not a crime, its just good to not let other people suffer from passive smoking in public places.
