I seems to be seeing people trying to sell MySpace Account here and I thought that the Terms of Service say that transferring accounts are illegal at least that is how I read it. http://www.myspace.com/Modules/Common/Pages/TermsConditions.aspx Does this rule applies to some accounts and but not others ?
True, if people follow the laws, there wouldn't be any crime around. I guess those who breaks the terms are people who don't read or just don't give a damn. But if Myspace finds out, the 'bought' account would be gone and the buyer would get nothing. When MySpace was privately own, it may not have the legal might but now that News Corp is the owner, it would have a lot of legal power to do anything and everything in its power to enforce the stated Terms.
I think it is important to keep in mind that legality is a relative term, especially in this situation. There is a big difference between it being against myspace's TOS and it being illegal. With that said, it is like any "Law", it's all about jurisdiction. In this case the jurisdiciton happens to be myspace, and they can certainly delete an account if they find out it has been sold. What exactly is in the power of News Corp.? At a civil level, yes, they could certainly sue you, but I have a feeling that they have bigger fish to fry than somebody selling a myspace account. Then again, I could always be wrong here, one would think the RIAA would have bigger fish to fry than grandma downloading some MP3's too..
i don't think myspace would have to time to look into a case-by-case basis... as such, i don't think individual users would face problems selling their accounts... however, i think you may start getting some heat if you make it into a big business with a dedicated website and all...
