If they are linking to illegal files then i don't think it will be legal.

It depends on what country you and your servers are located in. Other torrent search sites have had serious legal troubles (see http://en.wikipedia.org/wiki/IsoHunt#Lawsuit), so there are definitely risks to running such a site.

All of you didn't get what he was saying -

HE IS LINKING TO TORRENT SITES TORRENT LINKS...

He isn't actually hosting the torrents, So yeah your legal as long as your TOS is fairly well " manicured ".

Just act as a directory, not a tracker or torrent search engine.

MPAA don't care about directories, they care about the large torrent seeds & trackers.

    Good luck :)

    Regards,
    SSANZ

No one can answer this. No lawyer can answer it, no IT guy can answer it. No judge can answer it. Even if you could get an answer, the RIAA might just sue your company anyway, and maybe you too.

There is the law, and then there is the uncertain, grey netherworld that file sharing lives in. The netherworld is scary because you just never know what will happen.

Uncertainty in law favors "monied might." (Dickens)

Legally you are in grey territory for the most part. Places like Texas have had suits where links were deemed illegal. Germany has already been mentioned. It's only a matter of time before linking to known illegal material will be against the law. Also don't be suprised if your host gets complaints and just shuts you down. Hosts are notorious for being anti-torrent.
