Hi. I want to buy a domain name, which will contain the word "aix". Is this a ®? http://en.wikipedia.org/wiki/Aix Thanks, regards.
It depends on the exact domain name and what you intend to do with the site. Trademarks do not need to be registered, but there are a number of registered trademarks on "aix" - which doesn't mean that you can't use it in a domain.
Thanks for the reply, it will be something like aixforums, but in future when my forum will grow can i register aix.tld?
It depends on your usage. If you are using it to talk about another company's product or service, then it would likely be trademark infringement.
Hello everyone. Following the lines of FedeMan, I would like to know if a domain name is available, for example by godaddy, ipage, etc..., it is legally safe to purchase it ? If not, how can I make sure a certain domain name, photomsn.com for example is legal ? best wishes to all.
I think common sense and intent are important here. If you're willfully infringing on a trademark, that is definitely a bad idea. Putting "MSN" in your domain would fall into that category. If you THINK it might be trademark infringement - ask a lawyer before registering the domain.
It all boils down to one question, "Can your name easily be mistaken for or confused with being associated with the trademarked name ?" If the answer is no, you should be fine.
