Is it legal to put rhinestones on a hat and sell it?

    I am in Florida, USA. Is it legal to purchase a NCAA licensed baseball cap and put rhinestones on it and sell it for more?

    Example: I purchase a licensed NCAA Florida Gators hat. And i put orange rhinestones on the letter F. Then i sell it for more.

    Is this legal?

    Same would apply for NFL, MLB, NBA??

    I live in Florida, and from my experience many shops do this without any issues.

    Not specifically related but there is a company that takes Igloo coolers and sticks a radio in it. They don't work worth a shit apparently. Said reseller accidentally printed my businesses 800 number(had it for like 6 years) on said coolers that don't work. I am still sorting out how to fix this 6 months later. I get tired of folks calling me at 3am because their cooler does not work.. So, clear way to contact you is helpful.


    Long story short, just don't peddle crap and you should be all set in this case. Igloo could care less in mine :(

    I am not a lawyer though. I would wait for mjewel or a few others who have their fingers on this sort of pulse.

    I've had some people say it's not legal and some say its fine. I guess i will have to talk to an attorney.

    You bought the hat, law of first say says you get to do anything you want with it, that includes burning it, eating it, gifting it, and selling it.

    You would have to read the license the NCAA or whatever group releases the caps under. Read that then you will have your answer.

    Yeah I agree 100%. While I haven't investigated it, generally speaking if you paid the licensing fee's (you haven't ripped off the product), you should be fine. The NCAA usually goes after people with counterfit products not altered.

    Heck, why don't you look at purchasing a license from them that specifically states you can do this type of stuff. Then you would be able to get wholesale prices for the hats as you would be a 100% legitimate distributor and could order direct from the manufacturer.
