Lets say I start selling a guide on something , take a video from youtube and then put it in my guide as part of a tutorial . Although I didnt upload the video. Is this legal ? My theory was that youtube is to share , I share for a price and profit off people that are too lazy to go check youtube before buying my guide. am i right? or is this illegal?
Depends on how you do it and word the legalities.... For example you can just place a disclaimer and say the persons who purchase tutorial do not own the video and that you are not selling the video, the video is only included as a guide and as a reference, then give credit to the creator of the video on the bottom of the page or on a credits page.
Don't know. (? ) Your nic say me, it's on the border of legal/illegal. No bad idea. ________________________________________________________ globehit.com | planetset.com | nymphone.com | masterlodge.com | - PM with offers
As long as it's part of the guide - then you'll be fine. selling just the video would be a different story. I think most people would like the extra views to their youtube video and extra publicity.
It is illegal on many fronts. First it is a breach of the ToS of YouTube (5.b and 5.e - probably more too). If you have a YouTube account this would be a breach of contract, not criminal but still illegal. Second it is copyright infringement. Yes, by uploading and allowing the embed code the uploader agreed that the video could be used under certain circumstances, but this is not one of those circumstances. Will people sue you, they might or they might not. Some people will take offense, some will see it as free views. And of course, all of that assumes the video that was uploaded wasn't infringing in the first place. Without getting permission, what you want to do is illegal. I find it funny that you say you want to make money off lazy people when this whole approach smacks of laziness to me.
mad me hundreds off ebay before i got my account suspended 1 year for having 2 accounts XD so my product is great and it worked. 100% positive feedback. ( btw the 2nd account was created when i was 10 to fool around with ebay , when i got a serious account at 15 , i forgot about the other and got a suspension xD....)
Its illegal per Youtube's terms of service. And it is not your work? So even if it wasn't in the TOS, there would still be copyright issues.
Illegal and highly unethical. And seems as though you are too lazy to make your own videos. SHARE doesn't mean STEAL
if your sharing with the whole world, Steal doesn't exist. I also have a very long written guide. I don't just sell the video.
The fact that you have a long guide makes no difference. You have no legal right to redistribute a video from YouTube except under the guidelines set forth on YouTube (which states for non-commercial purposes only, among other restrictions). If you charge for something you are not sharing, you are selling. If you don't have rights to what you are selling then you are stealing.
