Is it illegal to own Prescription Drugs site in USA ?

    Hello Everyone,
    I have one problem here, i have 2 prescription drugs website which is making $1200/Mo and there's one buyer who is offering me $5500 for the same. He's from USA but he's afraid that he cant own a drugs website in USA.

    Can anyone here who is living in states can comment on this issue ??

    $5,500 is far too low an offer for a site that is making $14,400 pa

    Whilst I cant say specifically for the USA in most countries it is dependant on where the site is server wise and where the company is registered rather than where the individual who happens to own it is. Germany is the only country I know of where this isnt the case and then this can probably be got around as a corporation is a seperate legal entity to the owner.

    It is legal as far as I know, but it would be wise to have a good disclaimer in there stating that you aren't responsible for anyone's health and that the site is not a qualified medical source.

    In all honesty, I think these kinds of prescription drug websites are immoral. Is it fair to try and profit from another person's poor health? I don't think people should be able to make a website about health-related topics unless you are qualified or if you have oversight from a qualified doctor.

    There are many people who will take perscription drugs not for ill health but for their other benefits - growth hormone or testosterone will both promote muscle growth and has been taken by atheletes etc (obviously against the rules of the game) to aid in their training. Having seen the price of my medication and the deman that exists on the "black market" it has been tempting at times ;)

    You can also seriously harm your health with growth hormones if you don't take them properly.

    It is true that prescription drug prices are very high, but there are other ways around the problem then resorting to the "black market". I wouldn't trust the drugs from these sources.

    I take a number of prescribed medications (a few of them controlled substances) and the government is really cracking down on this industry, especially since there are so many fake pills coming in from other countries.

    There is not cut and dry answer. It depends on the site, who the customers are, and what products are being sold.

    Pharmacy websites are not illegal in the US in and of themselves. There are activities that some of these sights participate in that make their actions illegal.

    For example, it is illegal to import drugs that have not been FDA approved. Some sites sell foreign made drugs that do not have an FDA approved formula.

    It is illegal to dispense drugs without a valid prescription. Many pharma sites offer a prescription service. Prescriptions that are not dispensed by a doctor that has actually physically seen the patient can be considered invalid and illegal.

    It also depends on the state the owner (or even the customers) live in. Arizona, California, Colorado, Connecticut, Illinois, Michigan, Kansas, Nevada, New Jersey, Ohio, Texas, Washington, Wisconsin, and Wyoming have all enacted their own regulations regarding this. Penalties range from C&D letters to fines.

    It also can depend on what drugs are (or are not) available from the website. Narcotics can lead to a big hassle.

    That's how things are now. The US government is moving towards being more restrictive and not less.

    It is my understanding that in most cases US website owners must abide by US law as well as the laws in the country where their website is hosted. Even if the business is registered in said other country. There are some exceptions, but merely hosting and registering the business in a foreign country is not guaranteed protection for a US citizen to break US law.

    Online Pharmacy Charged With Fraud

    SAN DIEGO (AP) -- Physicians and executives are among 18 people accused of selling prescription drugs over the Internet to people without any examinations, according to an indictment unsealed Thursday that charges them with federal racketeering.

    The 313-count indictment marks the first time organized-crime statutes designed to combat drug cartels and mafia rings have been used to charge anyone with selling prescription drugs over the Internet, said Lauren Mack, a spokeswoman for U.S. Immigration and Customs Enforcement.

    AffPower, a Costa Rica-based company, took more than 1 million orders for legal pharmaceuticals including diet pills, birth control pills, Prozac and Viagra between August 2004 and June 2006, according to the indictment. It says the total value of the drugs sold exceeds $126 million.

    A network of affiliated Web sites received a cut of fees in return for each order forwarded to AffPower.

    The indictment names doctors and pharmacies along with AffPower executives and recruiters.

    Doctors, who were paid $3 for each order reviewed, approved hundreds or even thousands of orders a day, the indictment says. The prescriptions were then filled through licensed online and brick-and-mortar pharmacies, who received between $5 and $13 for each order.

    The indictment, unsealed in federal court in San Diego, names three doctors licensed in Georgia, Kentucky, Ohio and Massachusetts and pharmacists in Colorado and Florida.

    The defendants were charged with multiple counts of racketeering, money laundering, mail fraud, drug distribution and conspiracy. The charges carry up to 20 years in prison and millions in fines.

    At least 11 of the defendants were arrested earlier this week in five states, Mack said.

    Efforts to locate an AffPower Web site or phone number were unsuccessful. Two federal officials said they did not know of a company contact.

    Online pharmacy charged with fraud is the URL. Actually one of my doctors had his RX information scammed and almost got caught up in this.

    After watching the show "Bitter Pill", it's a wonder why anyone would actually order from online.
