Is it copyright to use delicious in domain?

    Is it copyright to use delicious as a domain? like deliciousDVDs.com? kind of worried cause there's a social bookmark site called del.icio.us

    delicious is still a word. someone can't trademark words unless they are spelled uniquely. In the case of del.icio.us, it's because it's a domain hack. You should be fine

    dcoops advice isn't accurate...you most certainly can TM a common word like Apple for instance. TM applications are for USAGE..so if you use it for deliciousDVDs.com in retail or reviews I would think you are outside the scope of the social bookmarking site. Also del.icio.us owns delicious.com too.

    Not at all, your site will be operating in a completely different area than delicious' trademarks are.

    As long as your site isn't too del.icio.us like that people will think they're on a site owned by them you should be ok. If it's a social-bookmarking site about dvds, you may be putting yourself in danger.

    Then again, I'm not a lawyer either.

    @Rectangle, good thinking. I forgot to mention that scenario.

    Yeah as far as I am aware it goes like this:
    Apple Computing Services - not good
    Big Apple Web Design - good
    Apple Cooking Club - good
    AppleDVD - borderline/not good...

    At least that's my understanding...

    You would be fine to use it - your site is a totally different concept. If you took the name AND the concept, you'd be a copyright violator. Like someone else said about "Apple" - if you took the name and the concept it would be bad, but if you had a site like AppleRecipes.com of course it's not relevant, so you would be a-okay. :)
