Is Illegal To Sell Facebook Accounts?

    I know it's against their TOS to have more than one, but is it illegal for someone to sell them somewhere else?

    I realise the only reason you would want to sell a Facebook account is for advertising reasons, which is completely unethical. It's almost as bad as selling a database of email accounts.

    People don't want adverts forced upon them like that.

    However; Whether it's against the TOS or not, you'd have sold the account anyway so it's not your problem once you've handed it over.... Unless you're worried about getting IP-Banned that is..

    Either way, I wouldnt advise selling Facebook accounts for marketing schemes.. It's not really fair bombarding people with adverts on a social networking site.. In my opinion anyway :p

    When you sign up for Facebook, you are agreeing to their TOS. It will be against their TOS to do so and they can and will take action, for eg deleting of accounts if the case is small or seeking damages in courts by suing the persons concerned.

    How do you plan on selling the accounts? Is it accounts for you? Do you plan on selling the actual account or services to design it? Need more details as to how and why you plan on doing it to give better advise. I agree with others here if you plan on doing it for advertisement purposes. Are you selling the accounts' emails? If so, your in for a world of hurt.

    I don't really think it's "illegal", but more "unethical" then anything.

    If you put me on your friends list and I accept, I'd be pissed off if you started spamming me ads.

    I was just wondering if someone could load an account up with free advertising coupons and then sell it. This is of course, purely hypothetical. :)

    Are there any lawyers in here? Hell, I'd settle for a first year law student's opinion on this.

    It's illegal, The reason why is because it's against the TOS also because you are "renting" an account on facebook just like on myspace which is why they can delete your account without warning. It's as if I sell someone my drivers license. The facebook account was "rented" out to you and not the other person, even though it's illegal they won't actually catch you.

    It is only illegal if you pass the full ownership rights over to another person. However, as stated in Facebook's terms and conditions, you may not pass ownership rights over. But, it does not include (to my knowledge) that another person may log in to your account, only that you may not have more than 1 account. Therefore, if you allow another person to log in whilst you have the ownership rights and facebook possess master ownership rights of the domain, it is legal as long as the log-in does not break any of the Terms and conditions, of which if they do you will be responsible for. So you may include in your contract that the person using the account must comply with the Facebook terms and conditions.

    So generally as long as you don't transfer all access rights, it is actually legal. Although I don't have any sort of law qualifications, I still have a good knowledge of the US's, UK's and International laws.

    Beats me if any applicable law says it's "illegal" to do what you're asking, but
    that's what Facebook's terms say. Beats me also if they'll take action against
    you if you do what you're asking.

    i believe it's not illegal but against ToS hence facebook can take you down anytime.
