Is floating Google ads legal?

I heard Absolute in the script make it illegal, the ads does'nt follow the screen.
It scrolls off with the rest of the site.

If it is illegal, is there a better way without the "absolute" added?

Yes it is against the adsense TOS, i had them once and aunt adsense immideately sent a letter for it.

 

No floating adsense ads. Absolutely-positioned ads are OK as long as you don't use it for floating purpose. Don't use javascript to float it in front of contents or to fly the ads around, you'll be banned in no time.
