Guys I am trying to make a Terms and Conditions for all those guys who run/ freelance a Web Design services and also might be providing hosting services. I know TOS is different in different Scenarios but am sure 75% is applicable to all of us. What I am planning is to setup something where everybody can contribute there ideas and expertise and make ONE DOCUMENT. We put blanks/ options for difference scenarios,.. And then in the end, we can hire a legal expert to have a review if needed. Do you think something like this would be a good idea! If people are ready to contribute, I can go ahead and setup something. Let me know friends....
Laws vary greatly between states and countries. There is no universal agreement that would cover everything. A document that is applicable in 75% of situations is far too risky to use. The only way to do it right is to have an attorney craft one for your specific location and services. Saving a little bit of money initially usually turns out to be a very expensive mistake.
Whether you name it Terms of Service (TOS), Authorized Use Policy, or Terms of Use, they all boil down to one thing – the Terms and Conditions for the use of your web site. Properly written, the TOS becomes a contract between you and your web site visitors. Further, since you can dictate the terms on a take it or leave it basis, you are in a position to insulate yourself from most legal difficulties. You will want your web site contract to be specific to the use of your web site. Your terms are very important and will provide the basis of conduct for all users. You want your contract to reflect how you want your web site to operate. For all these reasons, you don't want some standard wording that covers only 75% of posibilities -- You want to be 100% protected! WARNING! One of the biggest mistakes made by corporate America today is not following its own published procedures. The TOS is a contract! If you do not adhere to the terms and conditions you will be in breach of contract and the user will have an easy time of defeating you in a legal proceeding. It is imperative that you understand and abide by your own terms and conditions! If you say you are going to do something, you not only need to do it, you need to document in writing that it was done.
