I currently have my site setup as "Crath Inc", as i have had since... 05 i believe? I just noticed there is an actually company at www.Crath.co.za from south africa? Does anybody think i will get in any trouble for using the "Inc" even though im not a "registered business"? im not really sure how any of this stuff works thanks!
i think yes because inc or not the actual name is still the same maybe you could add something to it to make it more unique
I do not think it is proper to use the abreviation when you are not actually a corporation. You should check with the PA SoS office to be sure. The problem is that you appear to be representing yourself as a corporation when, in fact, you are not one. I think they are right but I use to do it as well....shhhhh Check into becoming an LLC Limited Liability Company Crath LLC Means they can sue you and take your business but not your house or something like that...
There's no such thing as an implied Inc. like an implied TM. If you're not registered, you can't use Inc. Doing so wont benefit/protect you in any way.
There is nothing to call a copyright company about. Don't use INC if your not incorporated. And if your company doesn't sell in the same area as that other company (like both of you sell clothes) then don't worry about anything.
Yeah, if you're not incorporated, you're falsifying information I'd think. Dishonesty is bad personally and legally. Just take off the INC or get incorporated.
Well guys, thanks to all of your input, especially browntwn. I just called the PA Corporation Bureau, and it is a 1 time fee of $125 to register a business name, weather it be a corporation, incorporated, limited, company, etc. So I'm sending in the form and getting this taken care of. Thanks!
That's probably pretty smart. No point in taking an unnecessary risk here when the process is easy. Glad you got it taken care of.
crath: be sure you know the difference between a corporation and an LLC....you might be disappointed if you go for a corporation - they are an awful lot of work to maintain.
as long as the business stays inactive, aka makes under 500? a year, then i dont need to do a thing with it. what else would be involved? as long as it just kinda sits there. i believe this is just registering the business name into my name.
I highly doubt they will take any action let along notice your businesses at all. The internet is a big place.
I suggest you research the corperating in PA. It is a lot of work. You have certain things you HAVE to do, otherwise, there are heavy fines. You also have to keep extremely detailed books. Good luck though I don't know what PA requires sorry.
