You are really determined to prove that you are stupid, aren't you? The whole point of that law is that an American citizen can be declared an enemy combatant and be imprisoned without access to lawyers and court trial.
I thought the standard was that if the person (citizen or not) was detained on the enemy battlefield; they would be detained. That "american taliban" guy was detained on that basis - he was captured in afghanistan, I believe. The shoe bomber was engaged in a crime in support of that same enemy so was detained on the same basis. During WW2, we detained thousands of Germans, who weren't released until the end of the war. They were held without trial until the cessation of conflict. I think its important to be vigilant about the holding of people during conflict - especially citizens, but the cases people bring forward (padilla and reed) are not good examples that help their cause. Both were clearly acting against this country and working for a group of people that had declared war on us. Historical and judicial precedent is on our side here. I am not shedding a tear about those two. The "Quirin" case is the one most cited in support of holding enemy combatants. http://en.wikipedia.org/wiki/Ex_parte_Quirin Gworld and those against holding combatants think it's all black and white - you charge them or you let them go. Neither history nor judicial precedent says this is the case.
The problem is, Gworld is incapable of distinguishing between enemy combatants, and an average American Citizen. Gworld would like everyone to think that if an average American is jaywalking, they will be arrested, anally probed, and detained without counsel, or a proper trial. This is simply not the case. My suggestion to Gworld is to take a course or two in American history, polysci, and criminal law at a local community college, if they have those up north.

ANY person independent if they are U.S. citizen or a foreigner can be deprived of all human rights and be imprisoned without a charge or trial. 948b that you quoted talks about procedure for military commission, 948a only mentions person and not alien and therefore American citizens can be declared enemy combatant and deprived of their Constitutional rights.
LOL. Have you noticed how these people even fight to give away the protection that is given to them by U.S. Constitution?
