Is it okay to use an image of person on and website/landing page your create, if the product you are promoting is their own product?

For example, if I'm promoting Robert Allen's e-Book, can I use an image of him on my web page?

    Thanks,
    Benny

It depends on the context you are using it in. Fair use has 4 tests. You would fail the first test (commercial). However, if you are talking about a person and use a picture of that person it most likely will fall under fair use.

Like I said, context is everything.

As always seek a lawyer. I am simply going off my copyright law school books (case law).
