Personal experience means squat unless you have experienced everything. Furthermore, graphic artists and photographers are notorious for suing websites without first sending a takedown notice or request. The same is true of the RIAA. That may not be the case with this particular website (probably not seeing as how they don't have a ToS), however, suggesting to somebody an action that gives no legal protection when the consequences could cost tens or even hundreds of thousands of dollars in legal fees and/or fines without mentioning the fact that you are assuming the people that are being infringed upon will choose to do things the nice way is negligent. Yes, probably 99% or better of all cases are dealt with in a decent manner and the person being infringed upon is satisfied with simple removal. However, there are many comanies and people that 1) have a website but do not understand the web culture and will go to their lawyer first (who might very well suggest a suit), 2) do understand the web and will send a takedown notice to the webhost before contacting the webmaster and may even try to get the site deindexed from SERPS, 3) are just mean and waiting for somebody to do just this type of thing so they can take them to court. Without knowing the risks, large or small (and while the percentages are small, the dollar amount is high) a person cannot make a truely informed decision.
