Image Results and TOS

    The Following below is from the TOS

    Can explain plz explain to me what has been meant by Image Results plz .. Myspace Resource sites have images also :confused:

    Ha, never knew this...

    A search result for media is not hard to understand, for example, In my free image hosting I had a search button for uploaded images (which I removed entirely to avoid any complications with Google).

    I think that is what it means an image search result.

    There are MP3, Video (e.g. Youtube) and other search results.

    As long as you have the rights/permission to have the images on your site there shouldn't be a problem. However if you have a copyrighted image you are using without permission the creator can report it to Adsense and get you banned. (They can also DMCA to Google and have your site removed from the search index as well).

    Hello, how will i know which image is copyrighted Plz? i am really worried about this :confused:

    If you run a hosting service, then you don't have to worry

    Just insure that you have "report file/image" link that actually works and when someone reports a file/image, you investiate it.

    Unless the owner doesn't hear an answer from you then they might resort to reporting you to your provider, etc..

    In general all images need to be seen as being copyrighted. As soon as someone creates an image or takes a photo that image is copyrighted. Unless the images are in the public domain (it should be clearly stated on the source's site) or you have permission to use it, you should be very careful.

    I've talked with various professional photographers on the issue, and they are quite merciless when it comes to protecting their copyright. Most of them won't bother contacting a site to complain... they just go ahead and file DMCA requests with the site host/server owner/search engines etc. After that they take legal action by sueing the site that hosted the image.

    If we are speaking about hosting services, not only would they be wasting their time, but also their money.

    Even if the images are on personal website, unless a person is stupid enough to sue someone without negotiating first, wasting thousands of dollars, I say its truly idiotic.

    As a hosting provider, if someone contacts me about a user I have, I would just remove the copyrighted material and leave the account and send a friendly warning notice to the user.

    Unless the site we are taking about is 100% illegal (cracks,warez,download etc).. Taking that person to court... Not even google would do it.

    Well I wasn't talking about image hosting sites per se. They do have a degree of protection limiting their responsibility for images hosted on the site. An actual example would be of some site e.g. a wallpaper site or a celebrity site, that uses on of the photographers images without permission.

    I might have used "sue" in the wrong context there, sorry. I actually meant that they used lawyers to handle the sites and legal issues. Not necessarily that it went to court, nor that the lawyers didn't consult with the webmaster/website.

    In most cases they have had some success in demanding and obtaining usage fees (often in the few hundred dollar - thousand dollar range). It all depends on the image and how far the author is willing to go to protect their copyright.
