image capturing a webpage .. is it legal??

    Is capturing a webpage as an image legal?

    Is there copyright regulations that make image capturing websites illegal? Does anyone know..

    capturing a image is ok, but editing and reusing it might cause issue
    also its important why it has been caputured, purpose of it.

    i have a site Rip that page Bitch that works by image capturing the webpage (via its url).

    I dont manipulate or edit it at all..

    Hopefully im not infringing any copyright laws in doing this.. (alexa type of image capturing is what i do)

    Size matters. If you are providing a thumbnail, that's fine. If your image is larger (like full scale), you can have legal issues.

    It's from a case in my copyright law school book. Reading case law is very important as codified law tends to just sent to general foundation.

    Chatting with IP lawyers is a good thing.

    If you are doing a large image, I would ask permission. It's the best policy. While many people might not mind, it just takes one to make your life go nuts.

    By the way, if these thumbnails are not linked in some way to the original site, you will have issues as well. At the very minimum, you should mention the site and some commentary if you did not link.

    One part of a case I read said the court found that the thumbnails didn't harm the marketplace for the plaintiff. This was part 4 of the 4 part fair use test. The defendant was using thumbs of websites as part of their search engine. They did link to the plaintiff's website AND to copyright information.

    As always, seek out an IP lawyer.
