Will be anonymous Like I usually do, I read one of the last senteces of the message and read "You now have 36 hours to respond.". I'm a 15 year old so I was so scared I did not know how to react. I'm new to the business of buying/selling as I'm usually a freelance designer, so I was sure I've done nothing wrong. He did not mention what script, but by his signature I knew what he was refering too. Terrorfied, I reply with this: After re-reading the message, I realised he was refering to someone named D*vi** (anonymous to avoid issues), while my name is Ruben, and Username Some Guy. So I replied once more: My question is, am I gonna be ok? I've never even been to court. And I've never abused the internet for anything illegal.
You might want to asteriks out that last quote of yours as well You have every opportunity to settle this. If you did it, just compensate the guy. If you didn't, then just prove your case. Don't use your age as an excuse, else you should have waited till you were 18. With professional communication anything can be achieved. Kepe being responsive and cooperative and you'll be OK.
I don't mean to use my age as an excuse, but my name isn't even the one he's refering too. Hopefully it was some type of mistake. I just wanted to share with you guys.
If you can prove you bought the script from that dude at talkfreelance it should not be any problems for you.
Then you have no need to be afraid. You can PM me to get into some details if you want. I like to listen about stuff like that. Thank you.
The guy who sent you this is a complete plonker for these reasons: 1: He claims he owns a software company, yet he is very unprofessional for practically calling you scum and not knowing how to file software copyright infringement claims. 2: He is more or lessn using threatening tactics by saying that he lives close by, ok not a direct threat but someone could easily take it that way. 3: He states you only have 1 option, he is not the law he has no right to lay out options. 4: He is using blackmailing tactics by requesting the persons name and address or he will take you to court. 5: He finally makes a threat by saying it isn’t an empty threat. Isn’t there a law in the US where if you threaten to take someone to court then you either have too or you’re liable? Sorry for my stupidity but I think I seen that in Law & order, lol. 6: The FBI will get involved. Now that’s funny! Something tells me that the feds have better ways of using their resources than chasing someone regarding a software script. 7: Finally giving you 36 hours to respond, again he is not the law. You can either totally ignore him or request that his lawyer sends the full information on the copyright claim, personally I would ignore him until you see something official. I wouldn’t worry about this clown.
if you did not do anything wrong, just ignore him... if he irritates you further in this forum, report him to the mods. the onus is on the accuser to prove that the accused is guilty...
Exactly. He's just trying to scare you. I wonder if the FBI has anything better to do then bust kids for "stealing" scripts on the internet ...
I agree , You have a better chance Of Rubert Murdoc coming to your house and spanking you for spamming myspace.......
But for future reference don't ever reply using the "i'm to young to be in trouble don't get mad at me approach"... Right off the bat that puts the other person in a better position (not legally but argumentively). Usually just think things out, and if you need help ask for it, like you did... Then make a decision.. Most threats on the web are just scare tactics and unjustifiable.
My understanding here is that some_guy bought a copy of an illegally resold script, then resold it himself. As a legitimate owner of said script, I would like to see him suffer the consequences, as well as provide all possible details about the party he purchased it from. If he didn't realize it was an illegal script, fine, he should be able to settle matters with the sender of that message. If you did realize it, that you should be even more motivated to cooperate.
Honestly this is the funniest post Ive ever seen...some guy writes a script that goes against myspace terms and conditions and then claims intellectual copyright on it and goes as far as to make mention of the feds.. LOL First his position being that of an individual can amass to nothing more than civil proceedings which is very important because in our country its illegal to threaten to take criminal action in a civil proceeding. Second, does this guy have a patent or copyright filed with the USPTO? I highly doubt it. Third the gov is not going to even bother with this... we have more important things at hand like corrupt corp exec's, terrorists, etc... Honestly I think piracy is not cool but this guy is ridiculous. Personally, and take it from someone that has dozens of patents on file, tell the guy to pound sand. Oh and one more problem, if his script violates any law or breech of myspace's terms and conditions and he is incorporated...dont worry the only thing the fed's will ask you for is to testify that he is perpetuating a criminal enterprise and defrauding probably one of the larger corporations for monetary gain....thats BIG BIG trouble.
Well if that PM was never meant for you, Instead it was meant for some Davies, Why do you think you can and in a problem. That certainly is a message sent to a wrong guy Cheer Up! I think you're gonna be fine
I hope this rat spends some time in jail... that will teach his sorry ass to not steal other people's work.
Interesting how quick people are to excuse his actions even though they aren't even close to aware of the full story. And as much as I would rather not open up a can of worms, here goes. The short version of the full story is that I was able to track down and identify 4 individuals who all knowingly obtained and then sold unlicensed copies of my MSRS script. Not one of them a day over 16. To his credit, the PM I sent him did contain the wrong name. Yes, I own a software company, and yes I have a lawyer. I have a daughter almost as old as these kids and I know how they act. In every other case I was able to talk to the kids and I really feel I was able to deter them from the path they were going down. They were on the wrong forums, willing to do anything for the easy money. Starting there can lead people to a place I'd rather not see them go. I would hardly call this individual innocent however. Is he going to post his actions here? Of course not, don't be ignorant. The fact of the matter is he did distribute it, he admitted to how he illegally obtained it and admitted he knew what he did was wrong. My claims are not false and they are most certainly not without merit. The FBI probably does have better things to do, but the law is the law. The intention of my message to him was not to scare him into giving me money. I didn't ask for any. I just want to stop seeing kids steal from other people and especially myself. All I wanted was for him to take his site down. Instead, he tried to sell it here on DP not more than minutes after our conversation. How honest. So go, rant on if you will about how I don't have this and I'm not that - it's your prerogative. But know that you do not have all the facts nor do you know people involved. Sure it might be a little embarrassing putting myself out there to be judged, but what you think of me isn't my concern.
I have to lend my voice to this in support of Greg - I've followed this thing via a number of forums and his script was being offered for sale. That may not seem to be a big deal to some people but when you pay for an exclusive script as I and a number of others have done, you don't want to see it being distributed to become just another freely available script. From Greg's perspective, he has every right to take any legal action he needs to in order to prevent his work being sold as knock-off versions.
I think the people who jumped in to defend Some Guy should have read his previous posts since he joined DP before giving him advice. Before commenting I thought I better do that first to see what he has been up to in the past. The result....he's a scammer and even though he's been caught out he continues to try and scam people. He also has a bad reputation for this on another forum.
