i'm going to sue Myspace.com

    Hi

    the other day i received an email informing me that Myspace is offering a $50 free credit for their advertising program, so i went to the site, registered, choose my country as Kuwait, got the email of confirmation, confirmed my email, then spent like half an hour designing my ad, in the end i reached a billing page, they asked for my credit card number so that they can hold a $25, this $25 will be released again, they only want to make sure that the credit card is working.

    so i entered my Visa detailes, and my billing address (which is Kuwait) and pressed submit, i received an error telling me that my credit card was rejected and i should contact my bank, i thought i entered one digit wrong, so i entered it again and i got the same error.

    after that i decided to use my Master card, also i got the same error, so in the end i thought maybe there's something really wrong with my credit cards, it was night, so i closed the browser and decided to call my bank the next day and check my credit card issues.

    i've a text messeging service from my bank, whenever i do any transaction they send me a msg to my mobile, so i received a msg on my mobile telling me that my credit card was debited with $25 for Myspace:eek::eek:

    i went nuts, i opened the site and tried to login it didn't log me in it kept giving me an error (no such username or/and wrong password) i clicked in the (i forget my password) and it asked for my email, i entered it and it gave me (no such email) :eek:

    i wrote to their support, they told me that the hold of my $25 will be released within 30 days, i should contact my bank!
    and my account was disabled because i'm not in the US, and the advertising program is for US citizen only!

    then why the hell did you allow me to continue the regestration even that i choose Kuwait as my country?
    why there was no warning from the very start that (this is only for US)
    why when i entered my billing address (where i choose Kuwait again as my country) the system did not stop me?
    why did you process the $25 hold of my account even that my card was issued in kuwait.

    they have replied me in regard of my questions :

    but there was no warning that this program for the US only, and they should have not allowed me to register after choosing Kuwait or any other country (other than the states)!

    do i have a case in here?
    i'm going to seek some advice from my lawyer friend and see if i can do something....

    your thoughts please...

    The hold for 30 days seems to be reasonably, litigation will cost you far far more money. Just wait 30 days for your money back.

    Wow, that IS annoying, and inconvenient.. but I don't think you have a case.. Just wait for 30 days I guess, but I'd be mad as heck as well if I were you..

    it's not about the 30 bucks my credit limit is around $20000
    it's about fooling me...and having an unstable website that gives (there was an error with your credit card contact your bank) and in the same time execute the transaction!
    it's about not mentioning that this program is for the US only and waste my time!

    Like a user above mentioned, Litigation costs for overseas will cost you alot more then what you want back, i'd suggest not going for that. Apart from that you aren't the first nor will you be the last who got bashed by Myspace trust me on this.

    So should i stay still and stay like a good boy waiting for the hold to be released...
    I'll give it a shoot, i've asked my lawyer friend once if reply me i'll post my thoughts here..

    They should mention during registration that it's for US ONLY, and/or reject any other country...

    That makes alot of sense, but the fact of the matter is that Myspace isnt the only website using this underhanded policy, i'd suggest that you give it sometime if nothing works out go for blood! *Not in the literal sense mind you* :D

    Yes we understand your rage, we would be just as upset and annoyed about it as you are if it happened to us.. But, in practicality, it will cost you more if you entered a lawsuit for a mere $25 against a company that is so huge they can squash you in seconds and all you'll get back is your $25 (which you would have gotten back in the first place if you waited for 30 days) and even more of your time wasted.

    So, in math, which one do you go for?
    $25 back and time wasted, OR $25 back + lawyer fees + MORE time wasted?
    (The first deal seems pretty promising, I'd take it if I were you :p)

    You could file a chargeback to the transaction inorder to get your funds back. In my opinion a lawsuit over $25 would be a waste of time and money.

    that's why I don't like going to myspace I think you should charge it to experience and be more cautious and be real careful this time. It's a waste of money and time when you go battle with myspace.

    Best to wait till the 30 day's are up, if nothing happens though i think it will. You can go right ahead and sue them straight away! :D

    Myspace are correct. There is a warning. Perhaps you should have read the terms a bit more carefully.

    Just wait the 30.

    It's clear about the $25 but no they didnt mention that they allow only US citizen.
    And if so, should their system reject my registration instead of keeping everything open and let me design my campaign?

    Guys it's not about the $25 please understand me:(

    I understand your concern abboodeh, but to some level everyone should at least consult the Terms and conditions in order to make sure they properly understand what they are getting themselves into :)

    Try asking an advice first from a laywer if he sees its a winning case.. Go on with the case.. I hope you get more than a million dollars if you win..
