well it looks like you copied his exact idea and just added a Z to the end. Why don't you clear it up in this thread and show your site and the site that you are accused of copying.

You copied his idea, and not only that, you copied his domain, what do you expect?

everyone copies ideas lets clear it up now look below-

Altavisa was first search engine then google came along - SAME IDEA!

myspace was social site facebook came along - SAME IDEA!

ebay.co.uk was auction site http://uk.ebid.net came alont - SAME IDEA!

Scriptlance freelance site getafreelancer came along - SAME IDEA!

break.com video site youtube came along - SAME IDEA!

i can give examples all day but all these ideas were improved and marketed better noone caused an upheave so why am i get assaulted when i just used a good idea. The mst important thing is you dont take someones hard hand coded scripts which we created from scratch

there is a big difference between plagiarism and constructive branching of originality. ie: if you take something and modify it to make it better(past the obvious). thats legit. if you take something and call it yours, thats plagiarism, and could be seen as an offense against the original creator(s).

i do side with Kelso on this arguement, but when it comes down to it, its not ethical. oh well, you should have registered your business and trademarked your creations Hecky...welcome to the real world.

I saw the other thread. Here's my two cents...

    1) Copying the idea is ok - happens all the time. There are patents and stuff to deal with it - i.e. 'one click shopping' etc... but this is taking an idea and (from what it sounds like) building a 'clone' site.

    2) That said, I would change the domain to something different - think of a better name. If the other party had resources, they might be able to go after you for just tacking a z at the end of his domain? Can't be too hard to think up a good name that's unique.

After that, it comes down to marketing, etc.

So, I guess I kinda agree with both people in this matter in one way or another.

To those leaving bad rep, that's just uncool, imho. (Hope I don't get any for saying so!)

Thank you but what people dont realize is that he only registered is domain 1 week before I did so he cant really do anything as im not getting anything ot of using his name because the name is not even recognized yet. People have also registered mysticky.com and his is mysticky.net. You are allowed to register domain if it desnt interfere with trademarks such as if someone registered ebayz.com before they trademarked there name there is nothing ebay could do because the domain was registered after the trademark was taken out. We own netafreelancer.com and when we registered we registered netacoder.com so noone could take it and i dont see getafreelancer.com on our backs and they know about are site. competition is healthy Nice advice from you any good rep coming your way

    Thanks

Ok, you may be right in a legal sense, but even so, it comes down to ethics (no offense...) Maybe I'm too ethical (surely not!), but it seems like it would be better to come up with a new name that differentiates yourself. What happens if you DO become huge with this idea - what about all the similar sites out there? People do mistype.

As I said, though, this is just my opinion. Coming up with a new name seems better for a couple different reasons at least. It will be hard to move the site, etc. but better now then when you have tons of traffic.

This whole thing does bring up an interesting issue, though, if the other party is under 18 years of age. Should us "old timers" try to help them out or fear them (for having not known a pre-internet period in their life...)?

There is no reason for you to post his age. It doesn't make him automatically inferior you too. You intentions was to copy his site. You posted on a free lance site that you want someone to create a site just like his. Not only that but you registered a domain that is very similar to his. You intentions were to knock him out and become a substitute instead of just competing.

Again, no need to stereotype, just because his 13, doesn't mean he doesn't have the funds. I'm also a teen, and I can easily take you to court every week for the next year.

You're getting attacked because you're acting like a jerk. It's one thing to steal an idea and a domain, but to have the attitude you've had is going a little overboard.

Maybe if you didn't try to dismiss Hecky because of age, over and over, you might have gotten more respect. You mentioned his age multiple times, not to just to point it out, but as some sort of insult to him. Like he said, you spell/type like a child compared to him, so I wouldn't go around insulting him. Also, this "kid" is the person you got the idea from in the first place. So what does that say about you?

Did Google call themselves Altavisaz; did Facebook call themselves Myspaces?

Copying an idea is fine (although whether it is ethical is another debate) but exactly copying someone's domain name, especially if they regged it first... Hecky should sue, although as i'm a legal n00b I don't know how worthwhile that would be :)
