Illegal script redistribution avoided by selling it ready installed as a "site"

    I've got a little problem with one of my free scripts. It's available free of charge under a few conditions, one of which is that redistribution of the source files are not allowed.

    2 days ago I was alerted to a topic where someone had taken my script, made a very minor adjustment (if site requested = youtube, use cgiproxy instead and similarly phproxy for orkut) and was trying to sell it for $60 each. The topic is here. After I told him it wasn't allowed, he tried to cut a deal which I didn't accept. At no point did he ever say he was going to stop selling it but after a few more responses from people who also saw what was going on, there have been no more replies to the topic. I assumed that was that.

    Yesterday this topic pops up and it's for a "site" that has no traffic, nothing like that, and is merely the script in question already set up on a domain and being marketed as a site. Today another identical topic comes up, exact same product just on yet another domain.

    I can only assume he'll continue this as if he was selling the script by itself. Is this a genuine loophole in my terms of use or does this technically still count as redistribution?
