Hello Everyone, Resently I was letting my spider check the attachments at my email hosting site when it found a file name of a (ISO) and in my TOC I say that I may check attachments if I beleave them to be illegal, so I checked it and it is indeed Postal 2 (ISO PC Game), now I have removed it from my servers but I don't know what action to take againts the user for uploading this 800MB illegal file? Do I just ban his account or do I report him to someone? (Afterall im not very happy with having illegal files on my server ) Your most, Daniel J Nethersole.
"Fair use" says you may make back-up copies of propritory software, but only for your oun personal use !!! Where and how you store the back-up is not a question. So them being on your server is not a problem for you, unless the are being shared with other than the owner/user of the hard drive space.
You may have another problem, soapbath. TOC or no TOC, you have just interfered with private email. Now I agree the fat lady has yet to sing on that issue but you're treading on potentially dangerous ground there. Yahoo recently went to bat to defend the privacy of email and I suspect that if it comes down to it the courts will rule in favor of the owner of the email, not the owner of the service. The exception to the rule is email sent on your employer's time using your employer's email service. I doubt that the courts would find you ro be in that category. If I learned that my ISP was intercepting my email I would (1) change ISPs and (2) sue their asses fast.
No no no! I don't touch the emails, just the file uploads. And well.. they agree to the TOC so they should understand. I do see your point, but 5GB of space could be used by people for piracy, and if my server turned into that.. im sure the courts would not like it either. (Sort of Lose - Lose)

Soapbath, TOC's might not matter jack I'm afraid. You need to do some reading up on the RIP act (as you're UK based) it's a f'in mine field.
