If it is availble it is legal?

    Hello everyone,

    I would like a clarification about the legality of domain names offered by well known companies.

    The question is: If a company, such as godaddy, ipage, etc..., has a domain name available for purchase, photomsn.com for example, it is for certain a legal name or not ?

    If not, How do I inspect its legal status?

    No it's not. It is your responsibility to check for trademark infringement on a domain BEFORE you register it. There is no easy way to check because trademarks do not need to be registered, and there are also international registrations. The simple rule is that you don't register domain names in an attempt to ride the goodwill of another company, website or business. Adding words to a domain name does not get around trademark infringement, and the TLD makes no difference.

    Had a friend register a name with godaddy only to be contacted by a lawyer from a company with that trademark name a few months later. He had to abandon the site.
