If I make wallpapers and avatars of bollywood filsm using pictures from net.. would it be going against copyright? This would be for people to download for free
You should ask this in the legal issues forum. Copyright and copywriting are completely different things. But in general, yes, you're violating copyright if you're simply pulling images off the Web, unless you first get permission or it's in the public domain, especially because your plans involve distribution. Pulling one still frame from a film wouldn't be using a significant portion of the work, and might be alright. But if you took something like an actual photograph of an actor for example, you'd be using most, if not all of it, and could have a problem. So it would depend a bit on exactly what kinds of pictures you're planning to use.
Maybe not what you are looking for, but my two cents: I would go ahead and make your pictures. I personally do this. Everyone else does this. If you were to get contacted by any copyright holders (this is highly unlikely), then of course you'd want to comply with any requests. Also, if you were selling them as a package, which you aren't, it might be a different matter. Finally, you could always host the pictures at a free image hosting site, or start your own image hosting site with your ads. I hope this helps. If you do any wallpapers of Josie Maran, let me know!
No they don't. Most websites use images that they have either created for themselves, or have obtained permission to use. All the rest are amateurs who know nothing about copyright law, and are just waiting to get sued. Try to obtain permission from the original copyright holders if you want to modify an image or a portion of an image, and redistribute it. Sometimes publicity images are put in the public domain, and you would be okay. But even if you are allowing people to download it for free, that does not mean that the copyright holder wouldn't be able to take you to court, because you may be taking away from their ability to market their own wallpapers. So stay on the safe side, and always ask before you borrow.
They aren't likely to see it this way. One the one hand they may not appreciate your graphics skills. On the other, if you are distributing them from your website, then you will be diverting traffic from theirs when people come to you for Bollywood wallpapers, instead of to them. They will see it as you advertising for yourself, most likely. Just go ahead and ask permission. That way you will know where you stand, and you won't always looking over your shoulder, so to speak, wondering whether the wrong people will visit your website and decide to take action against you.
Of course, you are using pictures of people without their persmission Now if you go out and take some pictures of cool things (not people), and they are your own pictures... then its ok

You are using pictures that you do not hold the copyright for. As several people have said previously, if you intend to do this then you need to ask the original copyright holder for permission to use the photographs. Period. End of story.
Exactly, and the web is largely comprised of amateurs who don't give two shits about copyright law. Of all the thousands upon thousands of celebrity fansites, very few would have obtained permission.
getting hold of a company in regards to using their images is a bitch I tried to get permission to distribute and profit from images of a xbox 360 game (as a skin) I was told no. It took a month to get hold of them and then I was told that there was no way I was allowed to use the images I'm not sure if they would allow it even if it was for free but so many people do it I guess.
The chances of them going after you for copyright infringement are significantly lower than the chances of you getting hit by a bus. If the risk of getting hit by a bus doesn't stop you from walking to 7-11, I don't see why the risk of a lawsuit in this spot should stop you from making wallpaper.
If that's the way you think, you likely won't survive in the business world. No one originally thought they'd risk getting sued for downloading mp3s either.... Just respect people's rights and don't be stupid just b/c you think you can get away with it.
