Idea for advertising, is it illegal?

I read a recent thread, talking about posting a video that has something related to your site, and posting your sites URL. Like at youtube, or google. I was wondering if using the Halo 3 trailer for example, and putting an ad to my site in the video, like before it starts , is illegal copyright wise.

Also, are there any other boundries I should pay attention to.

Rather than use a trailer why not take some pics of the footage then do what you want with it, all swings and round abouts but you can always twist things

Did you make the Halo 3 trailer yourself? If you didn't, do you have distribution rights? If not, it's copyright infringement.

Youtube doesn't actually check the content of the videos (or checks only superficially). By uploading, you are affirming that you hold the copyright, or that you have the rights to upload it. Now, if there is a complaint, YouTube probably wouldn't do any more than take the video down. The copyright holder, on the other hand, could choose to sue you for infringement. Is it likely they would do that? Maybe not. It's ultimately up to you to decide whether it's worth doing something wrong simply because you are unlikely to be punished.
