i was planning to launch a vedio upload for my members, but then the members will upload what ever they like. i may run into some copyright problems.

so, is there any method to determine that a perticular vedio has a copyright or not!

also, what kind of problems i may run into, if a copyright claim hits me, thanks,:)

You will need a scrict disclaimer. RapidShare.com's Disclaimer:

Ok, I'm assuming you are from the US or hosting in the US so US law should apply.

The DMCA will provide you protection under "safe harbor" provided:

If the content infringes copyright you could be held liable for damages up to a maximum amount of $150,000 per infringement. You should remove copyrighted material as soon as you become aware of the infringement, regardless if the copyright holder contacted you or not. In general everything except home videos are to be viewed as copyrighted. Even the home videos are copyrighted, but we assume that by uploading them to your site the member will grant you permission to use the video.

A disclaimer will not help you in any way.
