Hello, I want to know how much time to file a injury case after accident. If anybody knows please reply me ASAP. Thanks, feelme@alone
The answer would depend on where the accident happened or where you intend to file the case. Speaking to a lawyer is the best way to get the correct answer. I believe that most states have a 2 year statute of limitations on personal injury actions but some are different. A work accident also has different rules than a non-work accident. You can check here, but since there are exceptions and other facts that can alter the normal time, it is really best to speak to a lawyer who can get all the relevant facts from you and then guide you. http://www.expertlaw.com/library/limitations_by_state/
hi first of all take proper medications and proper rest, then try to file a case after discussing any lawyer who proper guide you. good luck
also i suggest you that visit the sites having keywords like accident, Injury, medicalnegligencesolicitors, accidentatwork, etc and you will get a lot of information you need.
it is more then just about time frame also...it can also depend on what type of injury, how bad the injury... I was hurt in a car accident due to the driver shooting a bottle rocket out the window, and he lost control... i was laid up for about a month, sure his insurance paid the bills, but for some reason, attys just blew me off.... so if you did not get a perm injury, lose a body part, loss of life or something like that, then it may not be appealing enough for an atty to pick up your case, as atty's are in it for the big bucks, not pennies on the dollar.... and of course it can also depend on if the party you are suing has anything worth while to go after.... and also consider that the atty is going to get anywhere from 30-50% of your settlement, if you win... I know people that have lost fingers in work related accidents, you would be shocked at the award you are given per loss of finger, it is not as much as you think, so your accident would have to be pretty bad if you expect to get a huge of monetary award from your accident, of course if you lost enough fingers to be considered disabled, or not able to work, then that is another story.... atty's do not seem to care about your pain factor, in my case, i was in bad pain for about a month, but they figured since i did not lose any body parts, and i was somewhat able to walk, it was not worth for them to get in the middle of my accident due to a careless driver shooting a bottle rocket out the window.... so there are a few factors to consider other then just time frame....
