I don't think you should have to take it down. You didn't make the video. Has the Lawyer threated YouTube??? I doubt it. Also where else has the video been seen. If it's a popular celeb then chances are it has most likely been see on channel like E! etc. Look around the net and find as many places as you can with the video and and news sits that have images of the video and wait for the lawyer to get back to you and say you will take the video down if all these people do and rattle off all the sites. That's what I'd do.

PS: How did he contact you. If it was via letter or email, how was it written?? It could be somebody's idea of a joke.

thanks for the replies everyone . i contacted a few other websites that also have the video posted and they told me they have not recievied any warning by the celebs lawyer . i dont know if they are just bluffing or if they have a ligitamit claim . i went to youtube & dailymotion and the clip is still there . my gut tells me they are just bluffing but i dont want to be wrong and end up in a bucket of hot water .

A)WHy dont you tell us whot he celebrity is? If you dont want to reveal your site that's one thing, but give us the link to the youtube site video. Nobody is going to hold you legally responsible for giving us the youtube link.

B)Short answer, no you can't be held liable for damages. Long answer, are you prepared to call their bluff? And if so, how far? If nothing else, they can send something to your web hosting company.

You cant get into any trouble here, The movie is hosted on
Youtube so they would be held responsible. Are you shoore
that this is for real and not someone playing with you? :D

    Is it really worth it?

Seriously, if the email is legit, is it worth risking the trouble and possible expense of legal action? Unless the video is very crucial to your site...I would take it down and just move on.

I'm sure it was an email sent to you by a fan of the celebrity. No lawyer would contact you personally about using javascript code to play a video hosted at you-tube. If anything, the agent of the celebrity would contact you-tube, not you! :)

my blog requires users to register and validate their email adress before they can leave messages on my site . just like this site does . ive checked the email used by the lawyer when they signed up and the email adress on his site and its identical . im positive this is not a trick used by a over zealous fan . plus theres photos of the celeb and the lawyer on the site

i plan on removing the link just to be on the safe side . but i wanted to know if this lawyer is just blowing air . because what if i see a clip a nfl game where payton manning throws 13 touch downs in one quater . and some one uploads it to youtube and i post it can the nfl come after me for using un authorised footage .

To be honest.... If this was a well know celebs lawyer they wont
waist their time with the websites that embeded this video but
with Youtube them self because removing the source from youtube
will lead to all embeded movies not working any more.... Problem solved;)

You're assuming that the intern who wrote this e-mail knows anything about how the Internet works.

You'd have to be damn stupid to leave up a video after being contacted by a lawyer. The revenue you'll get from the video will come nowhere near your legal expenses if only one of every thousand of these cease and desist orders are actually real.

Contact Youtube/Google about it and tell the lawyer to contact Youtube/Google.

If this situation was so serious then way don't Youtube remove this video
Like i said before... any good and educated lawyer would not wast their time
with browsing the internet and send out thousands of emails to each webmaster
having this movie on their site. Isn't it just common sense to remove the movie from the main source. That will safe them so much time.

So, I assume that any well educated intern that works for
a company that get work from celebrities will use their common
    sense.

I just gave my opinion and if he feels that removing the movie is the best
thing then he should do so... i never said that he shouldn't

You've obviously never known any lawyers, they're experts in law. They don't know anything about the Internet (in general).
