To my best understanding.... Both clasione and The Critic are right on target. Theoretically any creative or unique creation is copyright at its inception. The issue is about proving it. By registering a trademark you are creating a legal record of your claim to its use. Which gives a greater level of protection. However proof of prior conception and enough money/clout can move mountains...
