My blogspot recently got taken down by DCMA cuz I was streaming live cricket. There are over 1000 sites who do this everyday. Can I know if these 2 sites are legal. - http://www.crictime.com/ - http://www.webcric.com/ I just need to know if embedding live stream is legal. If it is not, is hosting like what those 2 sites mentioned above do, legal? In justin.tv and UStream's case. They host live TV. So is hosting channels that u have to pay for, live on the internet, legal? Can I know the consequences I will face if I keep embedding the the live channels from the above 2 sites on my blog, every-time DMCA keep taking them down I am confused in which to if I should carry on embedding these live channels on my site, or find an alternative income route. Many thanks in advance for help.
I do not think linking is illegal. The problem is no hosting provider is going to be tied to a site allowing the viewing of illegal content or content that is not their own, and most likely it is not, even if you are just linking, then it would be considered a valid DMCA. I know you guys do not want to hear this, but linking to anything that you do not own can result in a DMCA.
Yah I get it. But who do u think actually warned the DMCA abt my content. It's not really linking. It's embedding the live players from the 2 sites. And yah they do have their site logo on top of the player. If you go to those 2 sites, they just look illegal. Filled up with pop up ads. If then how did they manage to run their sites. Streaming live cricket of every single match so far. without any interruption. And done it for more than 3- 4 years if I am not mistaken. Do you think that one of those 2 sites warned DMCA abt my site. If not who else.. Shall I still carry on embedding live channels..
Anyone that visited your site could have started the DMCA... as for those that have been up for 3-4 years, I do not know, maybe they are non USA hosts... You can do what you like, but your host may comply with DMCA if they deem it valid, and you will not be hosting your material with them.
I live in UK. Not sure how this works over here. But the thing is. I embed their channel, though they place there domain title at the top of the player. It's in a way free advertising for them. None of those 2 sites have any contact details in which to contact them. Strange. And yah those 2 sites I guess are hosted in India or Pakistan. I am wondering if live tv is legal. then why can't this be. May be just the free TV channels everyone can see. So what do u suggest. Should I take my content down. Then I'll have to completely change the idea of behind my site. Thnx for the hlep. I'll check back for replies tomorrow. Good night.
If you don't own it, you need express permission form the actual copyright holder to display it, otherwise they can sue you. DMCA (a US law) applies if you're hosting is in the US. Blogspot will always comply with a valid DMCA takedown (including embedding), but that doesn't mean you can't still be sued. Other countries vary on their laws and penalties. Forget what other sites do, what you are doing is not legal and that puts you at risk.
TV networks buy movie rights so we can watch these shows on Cable/Direct TV, etc....If people watch what you call Free TV, then why would anyone need real TV? What would the point be for a tv network to buy movies if people cancel their cable/direct tv subscriptions? So no, they are not getting free advertisement, as you are getting a free ride... There is no Live streaming that I know of, why would any network want you to watch live internet over real tv? they do not, you always get re-runs, and nothing live that I know of...and these places that you are referring like hulu probably have contracts with networks. Besides, there is already TV streaming software out, it costs around $500 - I am not sure what type of rights they have. But no matter what you do, stream or offer live content, you will have to buy some type of rights to use, or forget it. everyone has to pay for something in life, and life is not free, and networks want their share also, you are no exception. just like netflix has contracts with someone so they can sell movies that put people like block buster out of business.
Thnx for the advice. I took them down. I believe the 2 sites I mentioned above do this illegally. That's why have no contact info available. Thnx for help in advance. I'll see what'll happen next.
