    This may sound corny, but I would look around at all of the hosts. Find the one that looks the best to you, and one doesn't oversell, and has good reviews. Then, I think you should develop a good trusting relationship with the hosts. Hosts in general don't feel personal to me anymore. I could be off my rocker :), but I feel that hosting is like a partnership. You as a hostee need to succeed by having your site up. For the host succeed, you need to succeed.

    When I hosted, I developed a relationship with all of my customers. That's way it needs to be. Hosts need to check in with their customers. Get to know them and everything. Just my .02, and maybe it's my southern hospitality upbringing :)

    Just got done with Hostgator chat. They keep referring to their TOS without clearly stating much other than they could sell me a dedication server which I don't really think I need. I copy/pasted the chat out of interest to see why it took almost two hours of chat for what could of taken 2 minutes.

    I just got done looking over your site. If I started a hosting company next week I would copy paste your TOS's in a heartbeat, they are great! however as a client I can not agree to them. I'm sure that they are not much different than any other hosting company that created a professional TOS, but they scared me away.

    Seems you might be best looking for an off shore solution.

    The RSS feed next to my user name is the type of boring home improvement stuff that I will host. With the exception of one of my sites that has a couple bad words, not one of my sites have bad words, images let alone some of the bigger crimes like spamming or any of the other crap.

    The two things that stuck out from your TOS were the releasing account info upon a written request from law enforcement. I think it should state a written request backed by a court order. The other thing was the fees/penalties, I can understand listing them up front (which is good) but overall they give the impression that you can and will charge people a fine for waking up in the morning.

    Once again, nice site, good prices and a really good price on the IP's. (I don't want to piss you off in case I end up doing business with you).

    Understood. Seems to me like you would have nothing to worry about. The reason for the "law enforcement" thing is because while we typically only release info via court order, the "law enforcement" covers a broad scope of offices, ranging from Dept of Home Land Security, and other such entities that may request information without a court order. As for "local police", etc., nothing has ever been released without a court order. The only information we've ever been asked for over 11 years in business is the kiddie porn/sexual predators, etc., which in each case was requested via court orders.

    I've only ever had to levy returned check fees/fines. The fees on CC's is pretty standard, especially since it costs us to run declined cards. When you have an account that gets declined routinely several times a day, those fees begin to eat into any service/cost. Again, fee wise, its pretty standard stuff. Its pretty rare anyone sees any fee or finance charge for that matter. We're pretty easy to get along with, and rather forgiving. Unlike the utilities, credit card companies, etc... we routinely remove late fees, and other fees that the system applies automatically either as a courtesy for communication with our clients, or upon request.

    Anyway, the TOS, as I am sure you are aware is there to protect both of us. How strictly it is applied is entirely different and generally at our discretion. Again, we've had very few problems in 11 years in business. The fee structure was put in place to deal with those customers that would sign up for service, use it, abuse it and then dispute the service they used. I rarely have problems even in that regard.

    Update, I ended up going with Jayshah(post 31). I would like to thank all of the people who took the time to post and offer their advice (not all the people who PM'ed me their affl. links).

    I sell for a living. If I can't get a sale the next best thing is an honest reason why I missed it. Sometimes the truth hurts but I learn from it and move on or change my ways. I took the time to post some feedback for the people who took the time to comment in this thread.

    Tastyweat, You really need to get a sales thread up and get some i-traders. You advice was great and I actually went through a bunch of your old post for about an hour today. Thanks for your time.

    Newgenservices, your detailed response was great, I went through a bunch of your posts today as well. Good i-traders (not many hosting ones). I'm not sure why I didn't choose you, your detailed response beat the crap out of the copy paste or 'see my thread' ones.

    Mia, thanks for your time it was a coin flip and the decided factor was one of Jayshah's clients testimonial about his service.

    Hostingspeak, thanks for your time, sort of cool that you helped out and your not even selling anything. Pm me in a week or so once I get all of my sites moved and the dust settles I will join your forum and post my hosting experiences.

    BR7- Hostagator is only good at paying nice $100 checks for having people get suckers to sign up. Their customer service sucks! I swear that they get paid per line of chat or per hour on-line. I am pulling my sites from them without caring if I get a refund.

    Iwhic- not that you posted or answered my PM, hope all is well. Before I started this thread I was going to offer you or Cameron my business. It looks like he is having some issues and maybe your are busy helping him or just took a couple of days off?

    Some of Dreamhost servers are down today... ( http://www.dreamhoststatus.com )

    For instance all my network hosted by Dreamhost (200+ domains/sub domains) are down for hours -and I was running marketing campaings/paid advertising- :(

    And even if it's not the first time and if I do have 3 other hosting companies for my sites, it's quite a headache to move a large number of domains and sub-domains

    Beware of Dreamhost anyway
