I have in my portfolio projects I have done while employed by a company, not all of it. I don't state that they are my clients, but work I have developed while working there. Today I received an email saying that I violated the Confidentiality, Non-Disclosure and Non-Solicitation Agreement I signed because I claimed they were my clients or I did the work for them as such and I have to remove them from my website. Since I never claim them as my clients or I did work for them, but projects I develop as Webdesigner, My question - is, Do I have to remove them or I have the right to showcase my work as long as I state that they were projects I developed? Please need advice on that ASAP.... Thanks, Guido...
How important is it to have those projects listed on your portfolio? That'd be the first question. Are there others in the works that could take their place? Agreed, you need the NDA for opinion. Localman www.simplesalestracking.com
I would remove those sites to avoid any possible legal action. If the company was paid for the designs you created as an employee, the rights to showcase such work belongs to the company. In the non compete and confidentiality clauses I had seen, you would have violated such confidentiality by posting websites, images, url's, etc. that were created while at work. Non compete clauses could also have kicked in as well since property owned by the company was being used to solicit or otherwise secure additional work outside of the company.
