He has no obligation to keep or provide a backup of a site that did not pay the bill and got deleted.

The only thing you can do is learn from your mistake.

Sorry. I realize that is not what you want to hear but that is the way it is.

You stopped paying, what did you expect?

Anyway, I think you might try to offer him another months hosting payment if you can retrieve your database. Hopefully he agrees and still has it. Other than that, you are probably screwed.

Yeah you don't really have a leg to stand on if you neglected to pay outright.

I almost get the same accident like this, they charged me annually but they so lazy to give me Quality return of what they are promise.to get the database back I think will be really hard although you have a power to forced the hosting owner, though it is good if you keep talking about him call him or post at any review site about them to looking for a feedback support

Sorry man, you don't have a leg to stand on. You will also not get your backup. If it was terminated it was deleted off the server. When I terminate a client I always make a backup and store it locally, usually on a DVD, for about 6 months or so. However, I charge $200 for those backups. It is a policy that me and the staff decided, since a lot of times clients don't keep their own backups. You should make backups weekly at least. Google for scripts to run to make your own backups. I understand you were away for a while., however, you should have backed it up before you left. Backups are the responsibility of the client, not the host, and that is more than likely spelled out in the ToS. Hosts have no obligation to make or maintain them. Most do, because they want to be customer friendly and what not, as well as have backups incase of a catastrophic hardware failure.
