I tried to deposit the check. The teller gives me this funny look and says she can't do it. It requires a dba.

Went to the bank manager to get a dba and they say they can't do it. It requires a trip to the local state offices which are 15 miles away.

The state says it takes a month for them to do the paperwork.

The bank manager said "it is ILLEGAL to cash a check which does not match the name on your account."

Someone else told me it is fraud to cash a check which does not match the name on the bank account.

How are you guys cashing a check which does not match the name on your account?

    Is this a bank issue?
Is it an issue of check size?
Is it an issue of money deposited?

This is all very frustrating. :(

does the address not match the account also? Just setup a DBA it takes 5 min at local state office or mail it in if they allow. I just did one last week as i am setting up a business took 15 minutes of my time and walked out with DBA proof.

I thought you had to register with your state to use a dba notation. I believe its just a simple for you have to submit to you state government.

Henny, I remember looking at these Wisconsin forms when I got my LLC a few years back. It might be the case where the bank just keeps the forms on hand.

A couple of years ago, I accidentally deposited an $80k check into my personal account that I was supposed to deposit into the business account.

My name isn't "Network System Architects, Inc.", but they deposited the check without blinking. Or, more likely, without reading.

Visit the drivethrough teller at 5 pm on friday (busiest time) , I doubt they'll be looking very closely at anything.

You need to have a dba to deposit a check that isn't made out to you. It's common for a bank to require that you file a ficticious business name or provide other documentation to have a business name on an account. It's normal for a bank NOT to cash a check in a business name via a personal account (they have no way of knowing who legally owns the business, even if the address is the same).

If you were to deposit several checks at once, a teller might not notice it and deposit it, even though they aren't supposed to. If you walk in with a single check, or ask them about it, the bank isn't going to let you deposit it or cash it. Using an ATM might also work if the tellers are busy.

Of course a bank manager could allow it if you had a good relationship with the bank and they personally knew you - but technically they aren't supposed to and they are asumming the risk if they allow it. The Patriot Act has made enforcement of these rules a lot more strict.

This seems to be what my bank is telling me.

I went and got the dba and had to open a business account (sure hope my tax liability didn't just get more complicated).

So, the check issue is over.

Thanks for all the help from everyone. It's taught me a few things about the banking system.

Operating under a business dba won't affect your tax liability as it doesn't change your entity status for tax purposes. You can have a sole proprietorship that operates with a business name - and you are still taxed as an individual. You are still operating as a business even if you choose to have the checks issued in your name as you aren't an employee of Yahoo and they are not withholding any taxes from your check. Some of your expenses are also eligible to be used to offset your income, including ISP costs, hosting, computer, etc - but that should be discussed with an accountant.

i have had the same issues and they told me that there were issues when u updated you info on the site that is was not updating in the financial dept that issues the checks.

They sent my first 2 checks to some dude that hijacked my acct and out of the 4k i never got a penny and yahoo admited it was there fault but would not do anything to make the sittuation right.

I refuse to pay taxes on this money when that time rolls around but since this issue i havnt had anymore issues.

hope you get yours worked out
