I am a victim of a fraudulent eBay seller.

I purchased an item from him on January 23 and five weeks later I am still waiting for my item to arrive.

I did not receive any tracking info to verify the seller sent the item.

eBay's staff took down all listings of the seller due to numerous policy violations just a little after I purchased and payed for my item. His eBay account is suspended, too.

I reviewed PayPal's policy and I am eligible to receive up to 200 Dollars. I payed 485 Dollars.

I am using Visa Electron debit card.

Please, help me recover the full amount I payed.

Easy - go in to paypal, go to the resolution center and open a dispute. If the guy doesn't respond and refund your money you accelerate your dispute to a claim and then paypal will investigate it and refund your money.

Thank you for your reply, sheilasultani.

I filed a dispute and I escalated it to a claim immediately because the seller is unable to respond according to PayPal.

I am eligible to receive only 200 dollars under PayPal's buyer protection program and I believe this could be all I am going to receive since the fraudulent seller had enough time to withdraw all funds from his account.

I am considering to charge back PayPal. Can I do it with a Visa Electron debit card under these circumstances ?

I am considering a charge back, however I am concerned it may be too late given the date transaction took place and the type of card I use.

Could you tell me can I charge back with a debit card under these circumstances ?

for your information a chargeback can be done even after 1 year but only under special conditions like you didnt receive the payment bills etc.... but yes it is possible to bring back your money no matter when you did the transaction and as far as i see its not too long for you.... so yes you still have lots of time to do the chargeback.. so just goto your bank tomorrow and fill up the chargeback form... and after a week you will get the money back... thats all you have to do... and after that if you can then find the scammer then give him a big slap on his face:D so that he can know you got your money back...:D

Make sure to read PayPal's TOS. I remember years ago (this was when PayPal was first starting, yeah that long ago) that if you did a chargeback via the issuing bank that Paypal might suspend / terminate your account. I remember reading people complaining about this years ago.

Their policy might have changed but Paypal's TOS is worth reading, especially if you have never read it. A request for your money back from the card association varies per issuing bank (and if it is a debit / credit card). The normal is 180 days, but it can be something like 60 days from the date the statement was printed. American Express though rarely has an time requirements.
