How will copied content affect my site?

I have used copyscape to check one of my sites and another site has ripped off quite a lot of content of my home page.
My questions are: how will Google see this copied content and who will it penialise (if at all)? Will it penialise both sites? How will it know who had the original content so it penialises the site trying to copy?

    Thanks.

the copied site will compete with your site in the SERPs.

for each page, the one that is better SE-optimized will be shown.

Google will neither penalize your site nor the other site.

Google cannot always know whose content is original.

if your site has better links than the other site, most probably it will get preference in the SERPs.

You should just have that site shut down.
