How can you prove that, like getting a log or something, so that you can ask for refund or even claim damages?

Refund they will most 100 % give you one month refund and kick you out. Damage? You must be jooking they will not agree to that. If you feel this way about your hosting just move on to another.

There are 3rd party websites that can monitor your site, but many of them just ping the server to check the uptime. I've seen my website down many times while the monitoring service tells me its up and running, since the server can still be pinged.
Some hosting providers will share the uptimes with you, others don't. Claiming damages will not happen, read the agreement, it must be in there somewhere. You could maybe get part of your hosting fee back, but thats all. Like said before: if your not happy with the hosting, move to another hosting provider

Sometimes it might be dns cache issue etc with your pc so you should setup a uptime tracker for your site you can try host-tracker.com they are pretty good plus they send email immediately on downtime :)
    Thanks,
    Saad :)

Shoemoney has a plan that guarantee's 100% uptime. It is pretty pricey though.

Yes he has with 100% uptime in last 7 hours but it's worth it if your site is bussiness related and your site revenue is alot. The price is 5,000$ a month but as i said before it's worth it and he already have customers :) anyway we are going offtopic here :)
