How to prevent yourself from being sued.

  1. #1
    If someone uses your website and is injured by something you suggested what do you do? How do you prevent yourself from being sued in this way?

    I don't have the money to buy a lawyer currently to write my TOS to be bullet proof. Any ideas?

    The only advice I can suggest is to not be handing out advice that can get people seriously hurt, like don't
    be trying to teach people how to swallow razor swords or anything. Keep it clean and you should be safe.

    I live in America though. You can sue if the coffee is to hot and it even says hot on the container.

    I try to promote sports and fitness with add ons such as listening to music during. Someone could easily kill themselves doing this.

    How do most fitness websites protect themselves?

    I haven't heard of a case when someone tried to sue a webmaster over something they read,
    but you can always try and copy a legal "ToS" form and edit it to your needs.

    oh ok, thanks for the information. I've never heard of it also, but it seems like you can sue for anything. Just worry about it since it's so easy to injure yourself doing something new.

    provide a disclaimer on your site.

    i'm guessing this is for your fitness site from your signature.
    if so, then you should add warnings in your exercise routines or diet routines (etc.) along the lines of "warning: this is potentially dangerous; perform with caution as to blah blah blah".

    Write a disclaimer...
    Mention in it that the user agrees to the terms and conditions if he's using the product or information.
    Also put in the TOS that the customer is using it on his own risk and make them agree that you are not liable for their mistakes or errors.. Mention the risks involved and warn them..
