Yes, if the domain is registered by someone else you will have to buy it directly from him/her. If there is no "domain for sale" message on the site and no contact details then try to look up the WHOIS record.
Yes Gauhar, use the administrative contact info found in the WHOIS record to contact them, or, as Twoism suggested, check if there is any indication of the domain/website being for sale. Backordering would only help if the registrant fails to renew their name, and even then, you have no guarantee of getting it. .
